Counsel for the DH along with DH.
1. This is a fresh execution petition seeking enforcement
of judgment and decree dated 27.04.2026 passed under
Order XII Rule 6 CPC.
2. No notice under Order XXI Rule 22 (1) CPC is
required to be issued as the application for execution has
been moved within two years from the date of the decree.
3. Upon filing of PF within a week, warrant of possession
in respect of premises as shown in the site plan be issued.
SHO concerned is directed to provide assistance to the
bailiff at the time of execution of delivery warrants, if found
necessary.
4. DH is directed to appear before Ld. ACJ (East) for
appointment of bailiff on 20.07.2027 and put up for report
before this court on 12.08.2026.
5. DH is directed to ensure that there is no stay against
the order sought to be executed and DH shall file his
affidavit to this effect at the time of filing of PF.
