Present: Ms. Riya Goel, Ld. Counsel for the plaintiff.
1. The present suit has been filed for recovery of an
amount of Rs. 2,00,000/-.
2. Ld. Counsel for the plaintiff submits that the loan of Rs.
2,00,000/- was advanced in the year 2018 to Late Sh.
Krishan Kumar and defendant no. 1 for a period of three
years. She further submits that, in discharge of the said
liability, defendant no. 1 and Late Sh. Krishan Kumar, issued
a post-dated cheque dated 05.07.2022 for an amount of Rs.
2,00,000/-, which was dishonoured on 13.07.2022. She
contends that the defendants are liable to repay the amount
and that the issuance of cheque constitutes an
acknowledgment of liability in view of the judgment of Hon’ble
High Court of Delhi in Rajeev Kumar Vs. The State NCT of
Delhi and Anr1. She further argues that the suit is within
limitation computed from the date of dishonour of cheque.
3. Submissions heard. Record perused.
4. Upon filing of PF within a week, issue summons for
settlement of issues to defendant by all permissible modes.
5. Copy of plaint be annexed with summons as per Order
V Rule 2 CPC. Summons shall state that the written
statement be filed by the defendant within 30 days from the
date of receipt of summons.
6. List the matter on 27.03.2026.
