In between dates, WS alongwith an application for condonation of delay
alongwith documents and also reply to the application under Order 39 Rule 1 and 2
CPC was filed on behalf of the defendant no. 3. It is submitted by Ld. counsel for the
plaintiff that he has already received the copy of the same.
Vakalatnama filed on behalf of defendant no. 4, 5, 6 and 7. The same is
taken on record.
WS filed on behalf of defendant no.8. Defendant no. 8 was served on
01.06.2023. WS has been filed without any application for condonation of delay. The
same cannot be taken on record.
Defendant no. 5 and 7 were served 11.08.2023. Defendant no. 5 and 7
are directed to file their WS within time stipulated by law.
Summons issued to the defendant no. 6 received back unserved. Ld
counsel for the plaintiff has submitted that defendant no. 6 was served through RC on
03.08.2023. It is further submitted by Ld. counsel for the plaintiff that he will file
tracking report alongwith affidavit within 3 days from today.
