no. 4 to 8 alongwith defendant no. 8.
1. An application has been filed by the plaintiff under
Section 151 CPC seeking appointment of a Local
Commissioner to conduct inspection and verification of the
life members of the plaintiff Sabha.
2. Mr. Jain, Ld. Counsel for the plaintiff, submits that the
present Managing Committee has been in office since
2012 and fresh elections are now due. He submits that for
the smooth and fair conduct of the elections, it is
necessary to verify the membership of the Sabha. He
therefore requested that a Local Commissioner be
appointed to carry out the verification process.
3. Mr. Ajay, Ld. Counsel for defendant no. 4 to 8 submits
that the Sabha has a total of 307 members and that
verification should be conducted with respect to all
members. He further submits that he has no objection to
the appointment of a Local Commissioner for this purpose.
4. In response, Ld. Counsel for the plaintiff submits that
the plaintiff has no objection to the verification of all 307
members. He submits that the scope of verification should
include —(i) scrutiny of membership application/proposal

forms; (ii) verification of payment receipts of lifetime
membership fees; and (iii) confirmation that the members
reside within the vicinity of plaintiff Sabha, in accordance
with Rule 2 and 3 of its Rules and Regulations.
5. In view of the submissions and consent of the parties,
Mr. Vineet Mehta, Enrol No. D/2300/99, office at
Chamber No. G-99, Lower Ground Floor, Basement,
Preet Vihar, Delhi-110092, Chamber No. 316, 3rd floor
Saket Courts, New Delhi-110017 also at Chamber No.
188, Western Wing, Tis Hazari Courts, Delhi-110054,
Mobile No. 9810353944 is hereby appointed as a Local
Commissioner to verify the members of the plaintiff Sabha.
The scope of verification shall include:
(i) verification of membership forms;
(ii) verification of payment of lifetime membership fee of
Rs. 2,100/- (except the 102 life members whose list is
annexed at pages 33 to 37 of the plaint); and
(iii) verification that the members reside within the
prescribed vicinity.
6. The verification shall be conducted strictly in
accordance with the Rules and Regulations of the Plaintiff
Sabha. The parties shall provide to the Local
Commissioner the relevant membership forms and the
bank account statement for the purpose of verification. In
case, the Local Commissioner finds any member to be
ineligible or identifies any disputed case, a separate list of
such persons shall be prepared and annexed with the
report.

7. The fees of the Local Commissioner is fixed at Rs.
45,000/-, which shall be borne by the plaintiff alongwith any
incidental/miscellaneous expenses.
8. List the matter for Commissioner’s report on
17.04.2026.
