Sh. Harsh Bhadhana, Ld. Counsel for the defendant
through VC.
Application filed on behalf of defendant seeking waiver of
cost imposed vide order dated 06.02.2026. Ld. Counsel submits that the
WS was e-filed through the e-filing portal on 25.11.2025 and that
physical copy of WS was filed on 07.02.2026. However, copy of the
WS was not supplied to the Ld. Counsel for the plaintiff.
Ld. Counsel for the defendant has annexed proof of
service of WS on the e-mail ID of counsel for the plaintiff. Counsel for
the plaintiff submits that this e-mail ID on which the WS was sent does
not pertain to him. However, perusal of the plaint shows that the
counsel for the plaintiff has mentioned the e-mail ID which is the same
on which copy of WS was supplied by counsel for the defendant.
Counsel for plaintiff has submitted that e-mail ID is no
longer in use and that the defendant be directed to supply the copy of
WS again.
Defendant is directed to supply the copy of WS to the Ld.
Counsel for the plaintiff.
Previous cost imposed vide order dated 06.02.2026 is
waived of.
Listed for filing of replication on 15.07.2026.
