Today, Ld. Counsel for petitioners has submitted before the court that
he is voluntarily withdrawing the present case after filing of the documents on
behalf of respondent no. 2 on last date of hearing, as no case is made out
against the ESIC/respondent no. 3 after filing of the documents by respondent
no. 2.
The petitioners are withdrawing the present case against the
respondents and the petitioners shall avail their other remedies as per law
against the respondents.
Separate statement of counsel for petitioners is recorded to this
effect.
In view of the same, present suit is dismissed as withdrawn by
the petitioners.
Petitioners may take their remedies against respondents as per law
before the appropriate forum.
No further action is required.
File is consigned to record room after due compliance.
Copy of order be given dasti to counsel for petitioners and counsel
for respondent no. 3/ESIC as requested.
