Present: Mr. Lalit, Ld. Counsel for the plaintiff.
1. An application under Order VI Rule 17 CPC, seeking
amendment of plaint, has been filed by the plaintiff.
2. Ld. Counsel for the plaintiff submits that by this
application, the plaintiff wants to amend paragraphs 5, 6, 7, 10,
11, 12, 13, 15 and 16 of the plaint. He submits that the
amendment related to the dates on which payments were received
from defendant No.1. He contends that the last payment was
received from defendant No.1 on 20.04.2023 and therefore, the
suit e-filed on 18.04.2026, is within limitation period.
3. The e-filing details have been filed on record.
4. I have heard the submissions and perused the record. The
suit is at an initial stage and summons are yet to be issued to the
defendant. Considering the nature of the proposed amendments,
the application is allowed and disposed of.
5. Upon filing of PF within a week, issue summons for
settlement of issues to defendant by all permissible modes.
6. Copy of plaint be annexed with summons as per Order V
Rule 2 CPC. Summons shall state that the written statement be
filed by the defendant within 30 days from the date of receipt of
summons.
7. List the matter on 28.09.2026.
