It is submitted by Ld. counsel for the defendant that an application
under Order 6 Rule 17 CPC as well as under Section 5 of Limitation Act are
pending for adjudication.
It is submitted by Ld counsel for the defendant that he does not
press the application under Section 5 of Limitation Act dated 23.07.2025 and
the said application may be disposed off as withdrawn.
In view of the submissions, the application under Section 5 of
Limitation Act is disposed off as withdrawn.
Heard on the application under Order 6 Rule 17 CPC.
It is submitted by Ld counsel for the plaintiff that he does not have
any objection if the said application is allowed subject to cost.
Accordingly, the application under Order 6 Rule 17 CPC dated
24.07.2025 is hereby allowed subject to cost of Rs 500/- to be paid by the
defendant to the plaintiff for the next date. Amended WS is taken on record.
An application under Order 7 Rule 11 CPC filed on behalf of the
defendant. Copy supplied.
