Defendant no. 2 already proceeded ex-parte.
Fresh Vakalatnama has been filed on behalf of the
defendant no. 1. The same be taken on record.
Ld.Counsel for the plaintiff seeks some time to file
replication to the WS filed on behalf of the defendant no. 2.
Plaintiff is at liberty to file replication with advance copy
of the same to the defendant no. 1.
At this stage, Ld. Counsel for the plaintiff states that the
application u/o 39 Rule 1 & 2 CPC is pending for disposal.
On this, Ld. Counsel for the defendant states that he has
no objection if the aforesaid application is allowed as the status quo
qua the suit property has already been granted by the Ld. ADJ in
another suit bearing no. CS 229/23.
In view of the above, application u/o 39 Rule 1 & 2 CPC
is disposed of as allowed.
Accordingly, the defendant is restrained from creating
hindrance in the peaceful possession of the plaintiff in the suit
property bearing no. 25/436, Trilokpuri, Delhi till the disposal of the
present suit.
Now to come up for completion of pleadings/A/D of
documents/framing of issues on 15.05.2024.
