Present: Sh. Narender Thakur, Ld. Counsel for the DH.
Nazir report filed has been perused.
As per the report, the certified copy of the mediation
settlement agreement has not been filed. The DH is directed to
file the same before the NDOH.
Notice issued to the JD has been received back with
the report that the person who opened the door told the process
server that he would appear before Court and banged the door
closed.
In view of the above report, it is abundantly clear
that the JD is well aware of the pendency of the present execution
petition and is willfully avoiding compliance with the terms and
conditions of the mediation settlement.
In such circumstances and in exercise of powers
under Order 21 Rule 32 CPC, let warrants of attachment of
movable property of JD be issued in favour of DH for a sum of
Rs.50,000/- on filing of PF, returnable for next date.
The DH shall appear before the Ld. ACJ, East, KKD
for appointment of bailiff on 09.07.2026 at 2:00 pm.
The process be returnable before this court on
21.08.2026.
