Fresh suit received under Order XXXVII CPC by way of
random e-allocation. It be checked and registered.
Present: Sh. Manish Kumar, Ld. Counsel for plaintiff appearing
through V.C.
The present suit has been filed for return of advance
payment made by the plaintiff.
Copy of the bank statement of the filed of plaintiff filed, is
taken on record.
Ld. Counsel for plaintiff submits that he has no objection,
if the present suit is converted to a ordinary civil suit. He submits that
he will make appropriate endorsement in this regard by the NDOH by
appearing physically.
Issue summons of the suit for settlement of issues to the
defendant on filing of PF and Speed post, returnable for 07.06.2025.
PF and speed post be filed within 15 working days from
today. Summons be given dasti to the plaintiff to be served through
speed post. Plaintiff shall file an affidavit of service alongwith the
requisite documents showing due service on the NDOH.
In case, the summons remains unserved for any reason
whatsoever, then the same be served by way of affixation.
