Ms. Arpita Biswas, Ld. counsel for the defendant no. 1 and 2 and proposed
defendant no. 3.
Proposed defendant Kamlesh in person.
Fresh vakalatnama filed on behalf of proposed respondent Kamlesh. The same
is taken on record.
Ld. counsel for the plaintiff has submitted that he has already filed an
application under Order 1 Rule 10 CPC alongwith amended memo of parties.
Submissions heard on the application under Order 1 Rule 10 CPC.
Ld. counsel for proposed respondent has submitted that she has no objection if
the application under Order 1 Rule 10 CPC may be allowed and proposed defendant may
be impleaded as defendant in the present case.
In the interest of justice, the application under Order 1 Rule 10 CPC is
allowed and proposed defendant is impleaded as defendant no. 3 in the present case.
Amended memo of parties is taken on record.
It is submitted by Ld. counsels for both the parties that the present matter has
been settled between the parties before mediation centre dated 04.08.2023. It is submitted
by Ld. counsel for the plaintiff that the present suit may be disposed off as settled.
Separate statement of both the parties is recorded in this regard.
In view of the same, the present suit is disposed off as settled.
File be consigned to the record room.
