Present: Ld. Counsel for the plaintiff.

Present suit has been filed on behalf of the plaintiff for recovery of Rs.
Rs.1,95,000/ alongwith interest against defendant no.1, 2 & 3.
WS has been filed in the present matter on behalf of defendant no.3
and same was taken on record vide Order dated 25.11.2023, subject to cost of
Rs.1,000/ to be paid by the defendant no.3 to the plaintiff.
Accordingly, counsel for defendant no.3 is directed to pay the aforesaid
cost to the plaintiff on the NDOH. Further, defendant no.3 is directed to produce the
statement of account for the deductions made in the loan account of plaintiff on the
NDOH and further to apprise the Court after deduction of the amount, how much
amount is yet to be recovered from the plaintiff as well as defendant no.1 & 2 in the
present case on the NDOH.
Further, last and final opportunity is given to defendant no.1 & 2 to file
WS in the present matter positively by the NDOH, subject to cost of Rs.1,500/ to
be paid by the defendant no.1 & 2 to the plaintiff on the NDOH.
Now put up for filing of WS and further proceedings on 16.05.2024.
Copy of order be given dasti to counsel for defendant no.3.
