checked and registered.
Present: Sh. Pratyaksh Gupta, Ld. Counsel for the plaintiff along
with plaintiff.
Arguments on the application seeking ex-parte ad-interim
injunction heard.
The court is of the view that this is a fit case to exercise
the discretion for granting ex-pate ad-interim injunction in favor of the
plaintiff and against the defendant. The defendant is restrained from
entering and creating disturbance in peaceful life and possession of
plaintiff over the Ground and 2nd floor of the suit property.
Plaintiff is directed to file affidavit in accordance with
Order XXXIX Rule 3 CPC.
Case file perused. Submissions heard.
Issue summons of the suit for settlement of issues to the
defendant through all permissible modes on filing of PF and Speed
post, returnable for 12.05.2026.
PF and speed post be filed within 7 working days from
today. Summons be given dasti to the plaintiff to be served through
speed post. Plaintiff shall file an affidavit of service alongwith the
requisite documents showing due service on the NDOH.
In case, the summons remain unserved for any reason
whatsoever, then the same be served by way of affixation.
