Order Details: COPY OF JUDICIAL PROCEEDINGS Pdf Text: Civ Suit 241/24 AJAY ARORA VS. KAMAL MADAN 14.05.2025 Present: Plaintiff in person alongwith Ld. Counsel Ms. Nidhi Gupta. Defendant in person alongwith Ld. Proxy Counsel Ms. Poonam. On perusal of the case file, it is observed that WS has already been filed. Ld. Counsel for the plaintiff states that replication was filed previously. Ld. Counsel for the defendant claims that a copy thereof has not been received. Copy supplied in Court today and it is seen to have been filed on record as well. Parties submit that there are no documents inter se the parties for the purpose of admission/denial. Pleadings are complete. The following issues emerge from the pleadings: Issue no. 1: Whether the plaintiff is entitled to a decree of recovery of Rs. 32,000/- as arrears of rent for the period July 2021 to 29.02.2024 alongwith interest @ 12% p.a. till realization? OPP. Issue no. 2: Whether the suit is bad for misjoinder of necessary party being brother of the plaintiff Anil Arora? OPD. Issue no. 3: Relief. No other issue is made out or pressed upon. Parties are directed to file list of witnesses within 15 days from today. Plaintiff is directed to file affidavit in evidence and supply advance copy of the same to the defendant at least a week prior to NDOH. An application under O 7 R 14 CPC also stands filed.
