Sh. S.K. Sharma, Ld. Counsel for the defendant.
Present suit has been filed on behalf of the plaintiff against
defendant no.1 ,2 & 3 for permanent injunction and rendition of accounts. As
per record, no WS has been filed on behalf of the defendants in the present
case and counsel for the plaintiff has submitted before the court that the
opportunity of defendants to file WS was closed vide order dated 11.12.2023
passed by Ld. Predecessor of this court.
At this stage, counsels for the parties have apprised the court that
an application U/O.VII R.11 r/w Section 151 CPC has been filed on behalf of
the defendants in the present case.
Counsel for the plaintiff has requested for one opportunity to file
reply to the said application of the defendants on the NDOH. Said request is
allowed.
Let reply to the said application of the defendants be filed by the
counsel for the plaintiff positively by the NDOH with an advance copy of the
same to counsel for defendants at least one week before the NDOH.
Now put up for filing of reply to the application of defendants/
arguments on the said application on 19.04.2024.
