Counsel for the plaintiff submits that the suit is well within the period of limitation as the period from 25.01.2023 to 20.01.2025 is liable to be excluded under Section 14 of the Limitation Act. Upon perusal of the file, it is seen that the earlier suit filed was withdrawn by the plaintiff bank on the ground of some technical defect. However, neither the order sheet permitting withdrawal nor the statement of the AR of the plaintiff discloses the nature of the said defect. Consequently, this court cannot determine whether the previous proceedings were prosecuted with due diligence and in good faith and whether the defect due to which the earlier proceedings could not be proceeded with was such as would fall within the expression ‘ defective jurisdiction or other cause of a like nature’ occurring in Section 14 of the Limitation Act. At this stage, ld. Counsel for the plaintiff seeks some time to place on record the certified copy of the previous proceedings and to clarify the reason for withdrawing the said proceedings. Heard.
