Though the case is at the stage of evidence, it is noted that the
plaintiffs in the present case have sought relief of declaration to have the
relinquishment deed declared as null and void. The relief for the purpose of
jurisdiction and court fees has been valued at Rs 200/-.
In the considered view of this court, the valuation of the relief for
the purpose of jurisdiction should have been at the value of the property/share
therein to which the document i.e relinquishment deed pertains.
Ld counsel for the plaintiff has sought time to make his
submissions qua the said aspect while asserting that submissions on this aspect
has already been made before Ld predecessor of this court.
At request of Ld counsel for the plaintiff, one opportunity is

granted to the plaintiff to address the arguments for the next date.
