Order Details: COPY OF ORDER
Pdf Text: 21 Civ Suit 200/24
Rajeshwari Vs. Jagjit Singh
02.06.2026
Present: Sh. Tahir Hussain, Ld. Counsel for the plaintiff
alongwith plaintiff.
Sh. Parmanand, Ld. Counsel for the defendant
alongwith defendant.
An adjournment is sought on behalf of the defendant
on the ground that the defendant inadvertently forgot to bring the
three receipts pertaining to payment made to DUSIB, which are
required to be tendered in evidence.
The adjournment is vehemently opposed by the ld.
counsel for the plaintiff. It is contended that the said receipts
were allowed to be taken on record at a belated stage pursuant to
an application under Order 8 Rule 1 A CPC having been filed and
despite the same, the matter is being unnecessarily delayed.
Heard.
Considering that the receipts in question have
already been taken on record, this Court is of the opinion that one
further opportunity may be granted to the defendant to lead DE
as denial of such opportunity at this stage shall cause prejudice to
him.
Accordingly, in the interest of justice, the
adjourment stands granted subject to payment of a cost of
Rs.1,000/- to the plaintiff. Cost paid.
Be put up for DE on 13.08.2026.
