Warrant of possession received back with the report that
same could not be executed as police aid was not provided. Objection
alongwith an application for stay of the execution proceeding filed on
behalf of the JD no. 1, 3 and 4 on 06.05.2023. Copy of the same supplied
to the Ld. Counsel for the DH.
An application under Order XXI Rule 35 R/w Section 151
CPC for breaking open the lock and providing police aid filed on behalf
of the DH.
Ld. Counsel for above stated JDs submitted that an
application under Order IX Rule 13 R/w Section 151 CPC for setting
aside ex-parte judgment dt. 16.01.2023 already been filed.
Heard on the application of stay of the execution proceeding.
Considering that an application under Order IX Rule 13 R/w
Section 151 CPC already been filed on behalf of the above stated Jds, so,
I deem it appropriate to stay the present proceeding till the disposal
of the above stated application under Order IX Rule 13 R/w Section
151 CPC.
At request, put up with the connected matter on 08.07.2023.
