None for defendant no.3.
Ld. Counsel for plaintiff submits that defendant no.3 is not
accepting the application of the plaintiff filed in compliance with the
judgment of Hon’ble Supreme Court of India in ‘Jigya Yadav vs.
CBSE’.
Perusal of file reveals that previously a counsel was
appearing on behalf of defendant no.3, however, none has appeared on
behalf of defendant no.3 since last multiple dates of hearing. Notice be
issued to defendant no.3 seeking an explanation as to why action
should not be taken for not accepting the applications filed by the
plaintiff. Notice be also issued to defendant no.3 to appear on the
NDOH. Copy of this order be given dasti.
Plaintiff is also directed to send the application to the
defendant school by way of speed post and file the affidavit of service
on the next date.
Ld. Counsel for defendant no.1 and 2 submits that separate
applications have to be filed by the plaintiff with respect to change of
date of birth and change of father’s name as the procedure envisaged

are different. Plaintiff is directed to make separate applications. List on
21.05.2025.
