Present: Mr. Jayant Pawar, Ld. Counsel for the plaintiff
(through VC).
Mr. Ayushman Das, Ld. Proxy Counsel for the
defendant (through VC).
1. Ld. Counsel for the plaintiff submits that he does not
wish to file replication and reply to the applications of the
defendant under Order VII Rule 11 CPC and Order VIII
Rule 1 CPC.
2. The application seeking condonation of delay in filing
the written statement has been taken up for disposal.
3. Ld. Counsel for the defendant states that there is a
delay of 59 days in filing the written statement. He submits
that the authorized representative of the defendant who
was actively involved and handling the affairs of the
defendant company, suffered a severe back injury, and
therefore, could not instruct the counsel. He further submits
that the matter was also pending in the Mediation Centre
and the defendant was making earnest efforts for
settlement of the dispute. He submits that the delay in filing
the written statement is inadvertent and non deliberate.
4. Ld. Counsel for the plaintiff submits that he has no
objection if the present application is allowed.
5. Accordingly, the application is allowed and the delay in
filing the written statement stands condoned. The

6. Ld. Proxy Counsel for the defendant seeks an
adjournment for addressing arguments on the application
under Order VII Rule 11 CPC on the ground that the main
counsel is not available today.
