Present:- Ms. Madhu Bala, Ld. Proxy Counsel for applicant
(through VC).
Non applicant in person.
This is an application u/o IX Rule 4 CPC seeking
restoration of the suit bearing no. 436/2020 which was dismissed in
default vide order dated 16.01.2025.
Ld. Proxy Counsel for plaintiff has submitted that the
main counsel could not appear on the date fixed for hearing due to
serious illness of his wife. The medical record has been filed
alongwith the application.
Defendant has submitted that the present suit be
restored subject to cost.
I have heard the submissions and perused the record.
Considering the reason cited in the application, the application is
allowed and the suit is restored to its original number. The application
stands disposed of.
At joint request of the parties, the matter/main suit
bearing no. 436/2020 is referred to Mediation Centre, KKD Courts,
Delhi. The parties shall appear before the Mediation Centre, on
24.05.2025 at 02:00 p.m. The case/suit shall be taken up in this
Court for settlement (if any)/further proceedings, on 09.07.2025.
