In view of the averments made in the application, the application
under Order 6 Rule 17 CPC is allowed. Amended plaint is taken on record.
Ld counsel for the plaintiff has submitted that another application
under Order 7 Rule 14 CPC has already been pending for adjudication for taking
on record document i.e site plan.
Heard. Record perused.
In view of the averments made in the application, the application
under Order 7 Rule 14 CPC is allowed and the document i.e site plans are taken
on record.
Ld counsel for the plaintiff submits that the plaintiff want to

withdraw the earlier application under Order 39 Rule 1 and 2 CPC dated
20.03.2025 and the said application may be disposed off as withdrawn.
In view of the submissions, the application under Order 39 Rule 1
and 2 CPC dated 20.03.2025 is disposed off as withdrawn.
Ld counsel for the plaintiff has also filed fresh application under
Order 39 Rule 1 and 2 CPC. The same is taken on record.
Issue summons of the suit for settlement of issues and notice of the
application under Order 39 Rule 1 and 2 CPC to the defendant(s) on filing of
PF/RC for the next date.
Defendant (s) shall file its WS within time stipulated by law.
