Present : Sh. Vipin, Ld. Counsel for plaintiff.
Today an application U/o 5 Rule 20 CPC has been moved on
behalf of the plaintiff seeking service of summons upon the defendant by way
of publication in the local newspaper.
Counsel for the plaintiff has submitted that the addresses given in
the memo of parties are the last known addresses of the defendant and no
other addresses of the defendant are available with the plaintiff bank.
In view of the same, the application U/o 5 Rule 20 CPC is allowed
and the plaintiff is given liberty to serve the summons upon the defendant by
way of publication in the newspaper Veer Arjun, New Delhi edition on filing of
PF and depositing publication charges within 7 days from today, returnable for
the NDOH.
Further, on application moved on behalf of the plaintiff bank, costs
of Rs.1000/- imposed upon the plaintiff bank vide Order, dated 02.04.2024,
stands waived off.
Now, put up for report of publication / further proceedings on
30.07.2024.
Copy of Order be given dasti to the Counsel for the plaintiff for
intimation and necessary action.
