Alka Dhingra Vs. THE SHO
13.02.2025
Fresh application received through e-filing. It be checked and
registered as per rules.
Present: Sh. Shushant Dutta, Ld. Proxy Counsel for applicant.
This is an application u/s 152 r/w Section 151 CPC
seeking amendment in decree/judgment dated 04.06.2024.
Ld. Proxy counsel for applicant has submitted that
inadvertently in the plaint, the name of the plaintiff’s husband was
mentioned as ‘Kanwaljeet Dhingra’ but in the Aadhaar Card the
name of the plaintiff’s husband is mentioned as ‘Kawaljeet
Dhingra’. He has submitted that the said error came to the notice of
the plaintiff when she received the decree issued by the court. He
has submitted that the error is arithmetical in nature and does not in
any manner prejudice the rights of the defendants.
I have heard the submissions and perused the file. The
perusal of the plaint shows that the plaintiff had mentioned the
name of her husband as ‘Kanwaljeet Dhingra’ and therefore the
decree had been issued as such. It has been now brought to the
notice that in the Aadhaar card the name of the deceased has been
mentioned as ‘Kawaljeet Dhingra’. The error is arithmetical in
nature and does not in any manner prejudice the rights of the
defendants.
Accordingly, it is directed that the name of the
plaintiff’s husband be read as ‘Kanwaljeet Dhingra @ Kawaljeet
