An application for condonation of delay in filing the
written statement is already on record. Arguments heard. There is a
delay of ten days in filing the written statement. The defendant is stated
to be a senior citizen who was bed-ridden at the relevant time. The
application is allowed subject to cost of Rs.2,000/- to be paid to the
plaintiff on the NDOH.
With respect to the application under Order XXXIX Rule
1 & 2 read with Section 151 CPC filed on behalf of the plaintiff,
separate statement of the defendant recorded that he will not create any
third party rights on the tenanted premises. As the relief sought in the
aforesaid application stands satisfied, the application is accordingly
disposed.
An application filed under Order XXXIX Rule 10 read
with Order 15A CPC for deposit of arrears of rent during pendency of
suit is already on record. Preliminary submissions heard. List for
further consideration on 05.03.2025.
