Court notice could not be issued to the respondent through whatsapp as his phone number was not provided. Further, the court notice issued on the address of the respondent has not been received back for the third consecutive time. Upon perusal of the case file, it is seen that the reply to the application under Section 340 Cr.P.C. has already been filed by the respondent and therefore, it is obvious that he is well aware of the present proceedings. In such circumstances, the onus was upon the respondent to keep track of the application and to appear for addressing arguments. Despite the same, in the interest of justice, best efforts have been made to serve the respondent with court notice yet again but the reports have not been received back. Accordingly, it is not considered proper to waste another date in attempting to serve the respondent and it is deemed appropriate to proceed with hearing the arguments. An adjournment is sought on behalf of the applicant to address arguments on the ground that the main counsel is not available today due to personal reasons. Heard. Allowed.
