On the basis of the pleadings of the parties, the following issues are framed:- (i) Whether the plaintiff is entitled to a decree of declaration, declaring the Will dated 09.05.2003, GPA dated 25.05.2009 and Affidavit dated 27.05.2009 as null and void? OPP (ii) Whether the plaintiff is entitled to a decree of permanent injunction, as prayed for? OPP (iii) Whether the suit is barred by Order II Rule 2 CPC? OPD (iv) Relief. 3. No other issues are pressed for by the parties. Nor does any other issue arise from the pleadings of the parties. The plaintiff Cont... -- 1 of 2 -- -2- and defendant are directed to file their list of witnesses within 15 days from today. The plaintiff is directed to supply an advance copy of the affidavits of his witnesses to the defendants, one week in advance of next date of hearing.
