Fresh suit received by way of assignment. It be checked and
registered as per rules.
Present: Sh. Naresh Gupta, Ld. Counsel for plaintiff.
This is a suit for declaration and permanent
injunction.
Ld. Counsel for plaintiff has submitted that the
plaintiff has filed a suit for partition which is pending adjudication
before Ld. District Judge and in response to the same, the
defendants in their WS have set up the plea that they are the
owners of the property by virtue of Will and GPA executed in their
favour by their late mother. He has submitted that the present suit
has been filed to challenge those documents submitted with the
WS filed in the partition suit.
Submissions heard. Record perused.
Upon filing of PF within 7 days, issue summons for
settlement of issues and notice of the application u/o XXXIX Rule
1 & 2 CPC to defendant by all permissible modes. Copy of plaint
be annexed with summons as per Order V Rule 2 CPC. Summons
shall state that the written statement be filed by the defendant
within 30 days from the date of receipt of summons.
Be listed on 27.03.2025.
At request, summons be given dasti to Ld. Counsel
for plaintiff
