1. Vide separate judgment, the suit of the plaintiff is decreed
for a principal sum of Rs. 98,300/-. The plaintiff has claimed
pendente lite and future interest at the rate of 18% per annum.
However, this Court finds the said rate to be excessive and not
in consonance with the prevailing market rates. Accordingly, the
plaintiff is awarded interest at the rate of 9% per annum from
the date of filing of the suit until realization of the decretal
amount.
2. Costs of the suit are also awarded in favour of the
plaintiff. Decree sheet be drawn accordingly.
3. File be consigned to the record room after due
compliance.
