Rahul Chauhan Vs. Cyber East
FIR No. 108/2025
P.S. Cyber Police Station
U/s 318(4)/319(2)/61(2)/3(5) BNS & 66D I.T. Act
17.11.2025
Present: Sh. Aditya Tripathi, Ld. APP for the State.
Ld. Counsel for the applicant/accused.
This is an application for bail of the
applicant/accused.
The allegations levelled against the accused are that
he is involved in offences U/s 318(4)/319(2)/61(2)/3(5) BNS &
66D I.T. Act. It is alleged that on 07/11/2025, a raiding team was
constituted on receipt of secret information regarding the
operation of an illegal call centre in residential building near
Paliwal Dharmshala, Guru Angad Nagar, Laxmi Nagar, Delhi.
On 08/11/2025 at around 3.00 a.m, a raid was conducted
consequent to which accused persons namely Shiva Gupta, Suraj
Kumar, Abhishek Sharma, Rahul Chauhan and Rahul Aggarwal
were found actively engaged in operating laptops and making
calls to foreign citizens while impersonating as foreign-based
technical support executives (“David and similar names) and
making VOIP calls using software such as Microsip, X-Lite and
Text Plus. They induced victims to install remote access tools
like UltraViewer, enabling them to take control of victim’s
computers, view bank details and deceive them into making
payments via Amazon Gift Cards (ranging from USD 50 to 500).
These gifts were further encashed in the U.S through “blockers”
and the proceeds transferred to the call centre owner via
mediators.

It is submitted by the Ld. Counsel for the
applicant/accused that accused be granted bail as no recovery has
been effected from the accused. It is further submitted by Ld.
Counsel for the applicant/accused that mother of the accused
Rahul Chauhan is suffering from medical ailments and he is the
sole bread earner of his family.
Ld. APP for the State has vehemently opposed the
bail application of the accused on the grounds that the
investigation of the instant case is at nascent stage. It is his
submission that the victims and the money trail are yet to be
traced. He further stated that one of the main conspirator i.e. JD
has also not been traced yet.
I have heard Ld. Counsel for the applicant/accused
as well as Ld. APP and carefully perused the record.
At the outset, it is to be noticed that the accused
persons were found impersonating as foreign-based technical
support executives and making VOIP calls to foreign citizens. As
is reported one laptop and mobile phone have been recovered
from the applicant/accused who is stated to have been actively
engaged in making calls to foreign citizens and cheating them. It
has also been apprised that the mobile phone recovered from the
accused consists records of the victims (USA citizens) and the
call logs consistant with fraudulent communications.
The facts of the present case disclose the
commission of a serious and organized crime, where an illegal
call centre was being run by the accused persons for the purposes
of inducing foreign citizens/victims to install remote access tools
which in turn facilitated the accused persons to deceive the
victims into making payment via Amazon Gift Cards. It is
further informed that the cheated funds were converted and
-- 2 of 3 --
routed through Bitcon (BTC) Wallets and other channels with the
assistance of an associate known as ‘JD Bhai’. It is reported that
the accused ‘JD’ is yet to be traced. It is further stated that the
victims are also to be ascertained yet. Investigation to trace the
money trail is also being carried out. Thus, the investigation is at
a very nascent stage. Enlarging the accused, at this stage, may
result in tampering of evidence. No grounds to enlarge the
accused on bail, at this stage, are made out. Accordingly, the
present bail application is dismissed.
Expression of any opinion herein above shall not be
treated as and expression on the merits of the case.
Copy of the order be given dasti as prayed for
Copy of this order be sent to Jail Superintendent for
information and record.
