Pdf Text: 17 BAIL MATTERS / 649/2026, SHAKEEL Vs. GNCT OF DELHI
FIR No. 10/2026, PS Yamuna Bank Metro
CNR No. DLET020366002026 14.09.2026
Present: Ld. APP for State.
Sh. Vipin Arora, Ld. Counsel for applicant/accused.
An application U/s 480 BNSS for grant of regular bail has been moved on
behalf of accused Shakeel @ Mohd. Sakeel.
Reply has been filed by the IO. Same is perused.
It is submitted that accused/applicant Shakeel @ Mohd. Sakeel is in JC
since 31.08.2026 and was falsely implicated in the present case. It is further stated that
applicant/ accused is the sole bread earner of his family and his family is facing
hardships in his absence. Applicant is ready to abide by all terms and conditions imposed
upon him, if he is granted bail.
On the other hand, Ld. APP for the state opposed the bail application on
the ground of gravity of the alleged offence. He further submits that accused is a durg
addict and his family has no control over him. He may jump the bail and again commit
such crime. Hence, it is prayed that the present bail application be dismissed.
Submissions heard. Record perused.
The Fundamental principle of bail jurisprudence postulates that bail has to
be understood as the rule and jail has to be seen as an exception. Plethora of cases have
highlighted some indicative factors like seriousness of offence, likelihood of accused
feeling from justice, role and conduct of the accused and possibility of accused
tampering with the evidence of the case or threatening the witnesses among other factors
which are to be taken into consideration while deciding a bail application. However, no
one factor can be taken as supreme for grant or rejection of bail.
Considering the entirety of circumstances as well as period of
incarceration and the fact that accused/applicant is no more required for custodial
interrogation as the recovery has already been effected, this Court deems it fit to allow
the present application of the accused.
