An application u/s 480 BNSS has been moved on behalf of
applicant/accused for grant of bail. Reply to the bail application has been filed by
the IO.
Submissions heard, record perused.
It is submitted by Ld. Counsel for the accused that the accused has
been falsely implicated in the present case and nothing has been recovered from the
possession of accused. It is also submitted that accused has a clean antecedents and
is not previously convict in any case. Accused has a permanent residence in Delhi
and is the sole breadwinner of his family. It has been submitted that accused is
ready and willing to furnish a sound surety.
Bail application is strongly opposed by the Ld. APP for the State,
assisted by the IO, submitting that the offences alleged against the accused are very
serious in nature and the co-accused is still at large. It has also been submitted that
TIP of the accused was carried out on 28.07.2025 where complainant correctly
identified the accused. Hence, bail application be dismissed.
Considering the seriousness of the allegations against the accused,
the fact that the other co-accused are yet to be apprehended, and also that the matter
is at the nascent stage of investigation, this Court not inclined to grant bail to the
accused.
Accordingly, the application stands dismissed.
