Matters are being taken up through hybrid mode.
Today, the undersigned is also working as Duty JMFC.
Fresh case is received by way of e-filing. It be checked and registered.
Present: Sh. Narender Singh, Ld. counsel for complainant.
Matter is at the stage of consideration.
Perusal of the record reveals that the return memo neither signed nor stamped.
In view of the above, court notice be issued to the concerned bank witness
(complainant's bank) to appear before the court alongwith relevant requisite record of the
cheque in question alongwith return memo and to explain the reason mentioned on return
memo, upon filing PF for NDOH.
Copy of cheque in question & return memo be attached with the court notice.
Perusal of the record also reveals that legal demand notice sent to the proposed
accused company returned to the sender. However, Ld. Counsel for complainant submits that
the same has been sent at the last known address of the proposed accused company.
Accordingly, complainant is directed to file affidavit of proof of service of the
legal demand notice to the proposed accused company on or before NDOH in view of
judgment ie. HDFC Vs. Amit Kumar, AIR 2010(NOC) 407 (DEL.), 2010 of Hon’ble High
Court.
One opportunity is given to the complainant to file form 32 by NDOH.
Put up for filing above said documents/further proceedings on 05.02.2025.
