Accused no.1 in person alongwith Ld. counsel.
Accused no.2 absent.
An application for exemption from personal appearance has been moved
on behalf of accused no.2. Heard. Perused. In view of averments made, same stands
allowed and accused no.2 is exempted for today only.
The accused submits that he has not been able to arrange fund.
The conduct of the accused is highly unacceptable in the sense that they
have not honored the mediation agreement and have repeatedly gained time. Despite
repeated warnings and opportunities, the accused has not made payment as schedule.
Accordingly, a cost of Rs.8,000/- is imposed upon the accused for non
compliance of the previous order and for causing unnecessary delay in the present
matter to be deposited in National Defence Fund. Cost deposited.
As per the mediation agreement a sum of Rs.4,50,000/- was to be paid
till date. However, accused has paid a sum of Rs.2,80,000/- till date. Accordingly, as
per the default clause of the mediation agreement, the accused has now pay the
default amount of Rs.1,70,000/- alongwith interest of 12% p.a. for period of six
months which amounts to Rs.10,200/-. The accused shall now pay a sum of
Rs.4,0200/-.
The accused undertakes to pay Rs.1,00,000/- by the next month.
Put up for verification of payment on 21.04.2026.
The SHO concerned is directed to verify the address of the accused
which has been mentioned in the order sheet dated 16.02.2026.
Copy of the order be sent to the SHO concerned through Naib Court.
