Order Details: COPY OF JUDICIAL PROCEEDINGS
Pdf Text: 31 CT Cases 1332/2023
KAJAL Vs. BHUPENDER SINGH /0 (Kalyan Puri)
19/08/2026
Present: Sh. Jasveer Singh Saini and Ms. Sandhya Dubey, Ld.
Counsels for the complainant.
IO is absent despite execution of B/Ws.
IO was summoned for necessary clarifications in terms of
previous order.
At the cost of repetition, it is noted that as per the ATR,
FIRs bearing nos. 839/23 and 927/23 have already been registered upon
the allegations levelled by the complainant in the present complaint. It is
noted that the copies of the FIRs bearing nos. 839/23 and 927/23 have not
been annexed with the ATR.
Ld. Counsel for the complainant submits that FIR Nos.
839/23 and 927/23 were registered on separate set of facts and the present
complaint pertains to a different incident.
IO was accordingly called for clarifications. A perusal of the
record clearly reflects that the IO has failed to appear before the court
despite repeated issuance of the process. Previously also repeated B/Ws
were issued against the IO. It is further important to note that due to the
non-appearance of the IO, NBWs were issued against the IO by the Ld.
Predecessor on 10/07/24. Despite issuance of NBWs and repeated
warnings of the court, the IO has again chosen not to appear before the
court.
Let a copy of this order be accordingly forwarded to the
DCP concerned to bring to his notice the casual attitude of the IO.
Let fresh B/Ws in terms of previous order be issued against
the IO through DCP concerned with directions to the DCP concerned to
ensure the presence of the IO on the next date of hearing.
Now to come up on 17/12/2026.
