Present: None.
Matter is at the stage of consideration and the complainant has not even appeared
once in the matter. Since the last 1.5 years the complainant has not even filed the physical file
and original documents on record. No justifiable ground for non appearance of the complainant
on all the previous dates of hearing has been made out.
Vide order dated 08.04.2024, 18.09.2024 & 01.04.2025 the complainant was
given one last opportunity to appear in Court and pursue the matter. More than 1.5 years have
elapsed and the complainant has not appeared in the Court. Today also none has appeared on
behalf of the complainant despite repeated calls. Sufficient opportunities and warnings have
already been given to the complainant. No reason lie before this Court to give another
opportunity to the complainant to pursue this matter. It is reflective from the conduct of the
complainant that the complainant is not willing to pursue this matter. It is already 2:00 p.m.
In view of this, present complaint stands dismissed in default for want of
appearance of complainant as well as for non-prosecution u/s 256 Cr.P.C. for non-appearance.
Accused stands acquitted for the offence punishable U/s 138 NI Act.
File be consigned to record room after due compliance.
