Counsel for the complainant submits that he does not wish to press the application for the separation of trial as both the cheques were issued in lieu of the same transaction. In view of this, the application stands dismissed as withdrawn. Notice of accusation is framed on the accused persons separately. Accused persons have not pleaded guilty and claimed trial. At this stage, admission/denial of documents under Section 294 Cr. P.C. done. Accused persons states that they will not dispute the genuineness and correctness of dishonor Cheque & memo Hence, 02 witnesses cited in list of witnesses by complainant at serial no. 2, and 3 stand dropped from said list. Ld. counsel for the accused persons orally prays that the accused persons may be permitted to cross-examine the complainant u/s 145(2) NI Act. Submissions heard on behalf of both the parties. Keeping in view the submissions made by the Ld. counsel for both the parties and the defence raised by the ac- cused, the accused persons is directed to cross-examine the com- plainant on the NDOH without fail u/s 145(2) NI Act.
