None for accused.
Matter is listed for consideration since 07.03.2024.
Since then the original case file has not been deposited. Multiple
opportunities have already been given to the complainant but the complainant has
failed to ensure compliance.
Vide order dated 07.03.2024, 09.08.2024, 28.01.2025, 10.02.2026, the
complainant was given one last opportunity to ensure complaince, appear in Court and
pursue the matter. Sufficient opportunities and warnings have already been given to the
complainant, however, the complainant has failed to place on record the original case
file. No reason lies before this Court to give another opportunity to the complainant to
pursue this matter. It is reflective from the conduct of the complainant that the
complainant is not willing to pursue this matter. It is already 2:00 p.m.
In view of this, present complaint stands dismissed in default for want
of appearance of complainant as well as for non-prosecution u/s 256 Cr.P.C. for non-
appearance. Accused stands acquitted for the offence punishable U/s 138 NI Act.
File be consigned to record room after due compliance.
