The undersigned is also looking after the work of Duty MM.
Bail application filed on behalf of the accused Harshit, U/s 437 Cr.P.C.
Present: Ld. APP for the State.
Sh. Rahul Tyagi, Ld. Counsel for the applicant.
Ld. Counsel for accused seeks grant of bail to the accused on the
ground that he is in custody since 15.06.2024. It is submitted that accused has
been falsely implicated and no recovery has been done from the possession of the
accused. If any, the same has been planted upon the accused in the interest of
justice bail may be granted to him.
Ld.APP has opposed the bail application on the ground that accused
has been involved in various cases. There are chances that the accused will
indulge in same type of crime if release on bail.
I have considered the submissions and perused the record carefully.
The investigation is at the initial stage, recovery has been done from
the accused. There are chances if accused is released be indulge in similar kind of
offence. Hence, at this stage, I am not inclined to grant bail to the accused.
Application stands dismissed.
Copy of the order be given dasti to the Counsel for accused as well
as IO.
