Matter is listed today for consideration on notice. Heard on notice.
Notice u/s 251 of Cr.P.C. is framed and served upon accused separately. Accused has
not pleaded guilty and claimed trial.
On the oral application for bail of the accused, the accused is granted bail, as the
offence is bailable in nature.
The accused is granted bail subject to furnishing of bail bonds in the sum of Rs.20,000/-
with one surety of like amount.
Bail bonds in the sum of Rs.20,000/- have been filed by the accused. Same are
furnished, considered and accepted.
Copy of the complaint book to be supplied by the complainant to the ld. Counsel for the
accused today itself.
Let the matter be listed for framing of notice, admission denial and consideration on the
application under Section 145(2) of NI Act.
The accused is directed to supply the advance copy of the application under Section
145(2) NI Act to the other side for the purpose of consideration.
At this stage, admission/denial of documents under Section 294 Cr. P.C. done. Accused
states that he will not dispute the genuineness and correctness of dishonor Cheque & memo Hence, 02
witnesses cited in list of witnesses by complainant at serial no. 2 & 3 stand dropped from said list.
On perusal of the defense of the accused and application under Section 145(2) NI Act,
there appears to be a element of defense requiring cross-examination of the complainant to ascertain the
source of the funds so alleged. Hence, let the complainant appear on the next date for the purpose cross-
examination.
