Stage : The matter is at the stage for framing of notice, admission denial and
consideration on the application under Section 145(2) of NI Act.
The accused was directed to supply the advance copy of the application under Section
145(2) NI Act to the other side for the purpose of consideration.
Proceedings :
• Adjournment sought on behalf of the accused on ground that the accused is not
available today owing to death of his uncle, heard, allowed subject to cost of
Rs.5000/- is imposed upon the accused to be paid by the aaccused to the
complainant on the next date. The cost is imposed as application does not
contain name of the person, who has expired, relation with the accused, date of
expiry and corroborating documents has been filed by the accused to show case
the need of absence from the court proceedings. Since no such documents has
been filed, the plea is vague and unsubstantiated.
• The cost is subject to waiver on furnishing the proof, and in case the accused is
not appear on the next date, the bail of the accused will be cancelled and bail
bonds forfeited.
• Previous cost unpaid.
Order :
• Let the matter be listed on 18.08.2026 for surety bonds, framing of notice,
admission denial and consideration on the application under Section 145(2) of
NI Act.
• The accused is directed to supply the advance copy of the application under
Section 145(2) NI Act to the other side for the purpose of consideration.
