Present: Ms. Ria Goyal, Ld. counsel for complainant alongwith complainant.
Matter is at the stage of consideration of ATR.
Part submissions heard on behalf of the complainant.
Perusal of the record indicates that two status reports have been filed
by the enquiry officer in the present matter. As per the first status report, more
time was sought by the enquiry officer to take appropriate action and lies with
Ghaziabad police. As per the second status report, the enquiry officer submitted
that none of the offence alleged against the complainant took place at Delhi, but
since the allegations are serious in nature, the statement of the complainant had
been sent for legal opinion and further action will be taken in accordance with the
legal opinion. The second status report was filed on 13 January 2024. Since then
no further report has been filed before the court as to what action has been taken in
the matter by the police in accordance with the legal opinion which might have
been tendered by the concerned legal consultant.
In these circumstances, let court notice be issued to the SHO
concerned, to ensure filing of conclusive ATR clearly clarifying the stand of the
investigating agency in the matter and to also submit as to whether any cognizable
offence is made out in facts and circumstances of the present case. SHO concerned
is directed to ensure that the enquiry officer remains present on the next date of
hearing without fail. No request for exemption or adjournment will be entertained.
