Application for release of mobile phone make Iphone-13 on superdari
filed on behalf of applicant Kanishka.

Reply to the superdari filed. Case file perused.
In the present application, the applicant is seeking release of the
mobile make I Phone IMEI No. 2356417998729103 on superdari. As per
reply filed by the I.O, there is no objection if the mobile phone in question is
released to its lawful owner on superdari.
Submissions have been heard. Case file perused. On
consideration, the aforesaid mobile phone I Phone IMEI No.
2356417998729103 be released to its lawful owner subject to the following
conditions:
(1) That the lawful owner shall furnish a security bond to the satisfaction
of concerned SHO;
(2) That the lawful owner shall not sell or otherwise dispose of the said
mobile phone without the prior intimation to the court and shall produce the
said mobile phone as and when directed by the court;
(3) The I.O. shall prepare a detailed punchnama mentioning specific
details of the mobile phone including the colour, appearance, model number,
IMEI no., SIM no., and other necessary details of the mobile phone;
(4) The I.O. shall take coloured photographs of the said mobile phone
from different angles for proper identification of the mobile phone including
of the IMEI and SIM no. of the said phone;

(5) The photographs shall be attested and counter signed by the
complainant, lawful owner and accused; and
(6) The I.O. shall file the punchnama with a printout of the photographs
and a soft copy of the same in a pendrive/flashdrive and file it in compliance
of provisions of BSA, 2023.
Application is accordingly disposed of and be tagged with
chargesheet as & when filed. Copy dasti.
