Stage : The matter is at the stage of appearance of the accused(s) pursuant
to issuance of process compelling the appearance of the accused(s).
Proceedings :
• NBWs unexecuted qua the accused received back with report that
accused not found, this is the last known address of the accused as
per the complainant and no other address is traceable.
• Therefore, it appears that accused is evading the process and
issuance of the proclamation process is required.
Order :
• Issue process of proclamation under Section 82 Cr.P.C against
the accused for appearance within 30 days from the date of
publication in the court. PF be filed within 07 days.
• Process server to file the photograph of the process affixation in the
court and outside the address of the accused, file the GD entry, if
possible record the statement of the witnesses present there and
declare the proclamation by banging the drums and announcing the
name of the accused and next date of court.
• Let the matter be listed for report of the process server alongwith
photograph and details mentioned above for 05.03.2026.
