None for the respondent.
Stage : Fresh complaint under Section 138 NI Act has been filed for complaint case, the
matter is at the stage of pre-cognizance hearing under Section 223 BNSS.
Order :
• Issue notice to the respondent(s) under Section 223(1) BNSS 2023, alongwith
the copy of the complaint and documents, subject to filing PF/RC within 15 days
from today. notice be sent for service through all permissible modes including
electronic modes
• Format of BNSS Notice and Service Affidavit is available in the foot-note of the
ordersheet. Scan the same with the Camera, fill the details, take four printouts
and file the same with the PF in the Court.
• The complainant is required to serve the said notice alongwith copy of
complaint and documents, through physical service, Post and WhatsApp
alongwith proof of service of the notice, application and the complaint upon
the respondent. Dasti notice will be given. The complainant is required to
file the service proof and affidavit on the next date of hearing in the court
for effective service and further proceedings. In case, the accused has not
appeared despite service of the notice, it will be deemed that the accused does
not want to be heard on the issue of cognizance in the present case, and matter
will proceed in his absence on the issue of cognizance. Put up for further
proceeding on 20.11.2025.
