JYOTI/0 (Preet Vihar)
Present: Ld. counsel for the complainant.
None for the accused.
Stage: Appearance of the accused and return of Bailable Warrants for arrest of the
accused(B/Ws).
PROCEEDINGS:
1. Return of Process: Bailable Warrants (B/Ws) issued against the accused vide the
previous order have been received back unexecuted. The report of the executing
officer/process server has been perused. As per the report, the warrants could not be
executed because accused was not found at the given address.

of the accused cannot be secured through bailable process. As explicitly warned in the
previous order, stricter coercive steps are now necessitated.
7. Accordingly, issue Non-Bailable Warrants (NBWs) against the accused, to be
executed through the SHO, PS concerned. The complainant is directed to file PF/RC
within 07 days from today. The executing officer is directed to make sincere efforts to
execute the NBWs and file a detailed, forwarded report on or before the next date of
hearing.
8. Cost: A cost of Rs. 5,000/- is imposed upon the accused under Section 346 BNSS, to be
paid directly to the complainant on the next date of hearing
9. Warning for Proclamation: It is made clear that if the NBWs remain unexecuted and
the accused fails to appear on the next date, the Court shall be constrained to initiate
proceedings for declaring the accused a proclaimed person under Section 84 BNSS
(formerly Section 82 CrPC).
10. Let the matter be listed for the appearance of the accused and return of NBWs on
