Present : Ld. counsel for the complainant through VC.
Accused with Ld. Counsel Sh. Vibhor Tyagi.
Matter is at the stage of formal bail, framing of notice, admission denial and
consideration on the application under Section 145(2) of NI Act.
Today the accused has appeared with the Ld. Counsel on service of summons
and vakalatnama on behalf of the accused is filed and taken on record.
On the oral application for bail of the accused, the accused is granted bail, as
the offence is bailable in nature.
The accused is granted bail subject to furnishing of bail bonds in the sum of
Rs.5000/- with one surety of like amount.
The matter is at the stage for framing of notice, admission denial and
consideration on the application under Section 145(2) of NI Act.
The counsel for the accused has stated that matter may be proceeded for trial,
as accused does not wish to plead guilty for cheque dishonor, and formal framing of notice
may be framed with in terms of 251 CRPC/ 223 BNSS.
Formal notice is framed, the accused has not pleaded guilty having
understood the complaint filed against him and claimed trial. Admission/denial of documents
also done. Accused states that he will not dispute the genuineness and correctness of dishonor
Cheque & memo. Hence, 02 witnesses cited in list of witnesses by complainant at serial no. 2
& 3 stand dropped from said list.
In view of the submissions of the Ld. Counsel for the accused, framing of
notice and factual matrix of the case, the oral application under Section 145(2) NI Act is
allowed.
The matter is now listed for trial, and the complainant is recalled for his
cross-examination, and the matter is converted into summons case.
In case, the complainant wishes to file additional documents for proving his
evidence, post summoning evidence be filed with advance copy to the opposite party
alongwith relevant documents.
Let matter be listed for evidence of the complainant on 05.10.2026.
