• Stage : The matter is at the stage for framing of notice.
• Proceedings :
• Bail bonds in the sum of Rs.10,000/- have been filed by the accused. Same are
furnished, considered and accepted.
• The counsel for the accused is present in person and has requested that the notice
be framed through him only, and matter may be proceeded for trial as accused
does not wish to plead guilty as per the instructions received.
• Order :
• As per Section 251 Cr.P.C, formal framing of notice is not required, and the
counsel for the accused has submitted that the notice pertains to the cheque no.
000003.
• Hence, the formal framing of notice is dispensed with, and the counsel for the
accused submits that accused does not plead guilty to the notice and claims trial.
• Hence, the matter is now proceeded on trial. In view of the submissions of the
Ld. Counsel for the accused, and factual matrix of the case, the oral application
under Section 145(2) NI Act is allowed, as the liability is not admitted and the
complainant has not annexed any account statement or ledger account in the
complaint or evidence. The complainant is recalled for his cross-examination,
and the matter is converted into summons case.
• Let the matter be listed for CE on 22.01.2026.
